RSS and Nitin Gadkari

When IAC headed by Arvind Kejriwal came out with accusations against Nitin Gadkari on 17/10/2012 BJP took it lightly. Arun Jaitley said a mountain is made of what is not even a molehill. Nitin Gadkari said he felt laughing. Many journalists were disappointed that the expose was not explosive. IAC members defended themselves. Kumar Vishwas on Times Now said this is not a T20 match.

TV channels began their investigations into Purti Power and Sugar Ltd (PPSL). They discovered a web of companies in which driver, accountant, astrologer, and other workers of Nitin Gadkari were directors. There was demand that Nitin Gadkari step down as BJP President. Nitin Gadkari said he was ready for any probe. RSS was behind him. They wanted him to continue as president.

On 30/10/2012 IRB Infrastructure Developers Ltd came out with an advertisement denying any link between IRB Group and Purti Group.

Ram Jethmalani spoke against Nitin Gadkari. Mahesh Jethmalani on 5/11/2012 quit from national executive committee of BJP. Next day Ram Jethmalani’s letter to Lal Krishna Advani became public. Ram Jethmalani had written that he, Jaswant Singh, Yashwant, and Shatrughan Sinha wanted Nitin Gadkari to quit. On 8/11/2012 L. K. Advani turned 85. Nitin Gadkari met him to wish happy birthday.

S. Gurumurthy got into the act. As chartered accountant he went through papers related to PPSL and other companies and said there is no case against Nitin Gadkari, met L. K. Advani and briefed BJP leaders. Arun Jaitley and Sushma Swaraj prepared a joint statement which Ravi Shankar Prasad read out. The party was behind Nitin Gadkari.

RSS defends Nitin Gadkari means RSS is corrupt. RSS officially says it is for BJP to decide about its president, unofficially it tells BJP leaders what to do. Nitin Gadkari was RSS choice. Mohan Bhagwat wanted him to be BJP President. He wanted him to get second term. BJP constitution was amended to favour Nitin Gadkari.

Apart from Atal Behari Vajpayee no other BJP leader has been able to defy RSS and remain in BJP. L. K. Advani had to quit as president for his Jinnah remark. There is the question of next prime ministerial candidate. Narendra Modi has many supporters, one of them is Ram Jethmalani.

IAC revelations led to copycat revelations by Y. P. Singh and Subramanian Swamy. Y. P. Singh spoke about Sharad Pawar and Salman Khan. Subramanian Swamy targeted Sonia Gandhi and Rahul Gandhi. He said Congress loaned 90 crore rupees to Associated Journals Pvt. Ltd. (AJPL) that published National Herald. AJPL was sold to Young Indian through transfer of shares. The deal was done to acquire Herald House. Young Indian wrote off the debt for 50 lakh rupees.

Manmohan Vaidya blogged Narendra Modi was behind the campaign to oust Nitin Gadkari. RSS said it was his personal view. S. Gurumurthy’s tweets about Nitin Gadkari created confusion. It seems there is confusion within RSS.

Sunil Gavaskar loses

BCCI has refused to pay Sunil Gavaskar as per his demand. Sunil Gavaskar had claimed that Sharad Pawar and Arun Jaitley had assured him that his dues will be paid. After that a news report appeared that said BCCI has rejected Sunil Gavaskar’s claim. Sunil Gavaskar said his faith in BCCI was shaken but he had no communication from BCCI. Sunil Gavaskar was with IPL in 2007-2010. Lalit Modi came in defence of Sunil Gavaskar. He said BCCI wanted Sunil Gavaskar with IPL to rival Kapil Dev who was with ICL and therefore Sharad Pawar promised Sunil Gavaskar four crores per year.

It is not clear whether four crores is inclusive of one crore by cheque or separate. Sunil Gavaskar’s loss is nine crores or twelve crores. Sunil Gavaskar did not ask the amount in writing. He said he trusted the President. Other reasons could he did not want to pay tax on that amount and did not want M. A. K. Pataudi and Ravi Shastri to know about it.

Rajeev Shukla has said that there is nothing in AGM or working committee records to show that BCCI had agreed to pay additional amount to Sunil Gavaskar and therefore there will be no payment. There the matter rests.

Sunil Gavaskar should have got his dues cleared when he was with IPL and Sharad Pawar was President. Legally there is nothing he can do to get the amount. Sharad Pawar and Arun Jaitley have not made any statements about this episode. They could be guilty of attempt to abet tax evasion and generation of black money.

BCCI is reluctant to come under RTI. It has official dealings and unofficial dealings and RTI will expose its unofficial dealings. BCCI crushed ICL through all means, fair and foul. There is cricket fatigue in the country and future IPL seasons may not be a success. Kochi Tuskers team was out after one season. BCCI cancelled Nimbus telecast contract because Nimbus defaulted on payments.

Fast for Lokpal Bill

Anna Hazare is on an indefinite fast for Jan Lokpal Bill. This bill is different from the Lokpal Bill the government has in mind. The government is not ready to meet representatives of activists to reconcile the two bills.

Lokpal Bill is a small step in fighting corruption at the top. The bill has made occasional appears over the last 42 years. Many people have come forward in support of Anna Hazare and there are indefinite fasts in various cities. In California, Indians marched supporting the fast against corruption. Candle light vigil has taken place.

The activists do not want Sharad Pawar, Kapil Sibal and Veerappa Moily in the drafting committee of Lokpal Bill. They do not want politicians to join their movement. Om Prakash Chautala and Uma Bharti had to go back. The activists want the committee to have five ministers and five activists. Swami Agnivesh wants a new constitution for India. Arvind Kejriwal called the people to come to Jantar Mantar and make it the Tahrir Square of India. The movement is known as crusade against corruption.

Permission of Speaker or Chairman should not be a requirement for prosecution of MPs. Permission of President should not be a requirement for prosecution of Prime Minister and other ministers.

Sometimes the motives of people who fight against corruption are questioned. Indian Justice Party lead Udit Raj has said that actions against K. G. Balakrishnan and Dinakaran are because they are Dalits. He did not say the two judges were not corrupt. He said “There were serious complaints against former CJIs A. S. Anand and Y. K. Sabharwal too. In Sabhalwal’s case, there was documentary too… But no action was taken against them. In the case of Balakrishnan and Dinakaran, both have been dubbed guilty without any clinching evidence.” Udit Raj can try to prosecute A. S. Anand and Y. K. Sabharwal.

The judicial system we inherited from the British has failed us. The system’s foundation is wrong. It says. No innocent person shall be punished even though hundred criminals escape. Hundred criminals escaping is not justice. Even one criminal escaping is not justice. The system’s foundation should be, No innocent person shall be punished and no criminal shall escape.

Punishment for corruption should be proportionate to the amount. If the punishment for corruption involving 100 rupees is imprisonment for a day, then for 10,000 rupees it should be 100 days, for 1,00,00,000 rupees it should be 1,00,000 days and so on. The punishment period should not have parole or remission. Time spent in hospital should not be considered and period of imprisonment should be extended accordingly. If any loss is caused to the country the loss should be recovered from the corrupt person and that is separate from the punishment for corruption. For example, if a man has a 20 crore rupees bribe and caused 1,000 crore rupees loss he should be punished for the bribe and loss should be recovered from him and if after selling his property if the amount falls short there should be additional punishment. If the act of corruption has resulted in the death of a person, the corrupt person should he hanged.
